In 2000, the Industrial Welfare Commission (IWC) introduced new rules known as "Makeup Work Time" provisions, following the enactment of Labor Code § 513 by the Legislature. These provisions allow employees to make up hours of work they miss due to personal reasons within the same workweek, without these makeup hours counting towards overtime calculations, except in specific cases of exceeding 11 hours in a day or 40 hours in a week.
For employees to utilize this flexibility, they must submit a written request to their employer each time they wish to make up lost hours. Employers are strictly prohibited from encouraging employees to take personal time off with the intention of making up the hours later in the week.
Labor Code § 513 outlines this "Makeup Work Time" exception distinctively from compensating time off provisions. This exception aims to balance the 8-hour workday standard while providing some flexibility for employees facing personal obligations.
