Can My Employer Make Me Work Seven Days a Week?

In many California workplaces, employees have the right to take one day off each week. This rule means that employers cannot make their workers work more than six days in a row. So, after working max six days, employees should get at least one day to rest.

If the nature of the work reasonably requires seven or more consecutive days, then it’s not illegal as long as the employee still receives the total days of rest in a month equivalent to one day’s rest in seven at some point in that month. Also, the minimum one day of rest in every seven days of work law does not apply to emergencies, work performed to protect life or property from destruction, or a train common carrier.

An employer who breaks this rule may be guilty of a misdemeanor.
