Employees who work in certain businesses like hotels, private clubs with 50 or more guest rooms, airports, airport services providers, and event centers, and who were laid off due to COVID-19, have the right to be offered their old job back or a similar one. Employers have to give priority to former employees before hiring new ones.
These "recall rights" are in place from April 16, 2021, until December 31, 2024. If employees want to be considered for rehire, they need to promptly give their former employer their current contact information. Employers must respond within 5 days to any notices from former employees.
If employers don't follow these recall rights, employees can claim $500 in damages for each day of violation until it's fixed. If employees face unfair treatment for asserting their recall rights, they may also get compensation for lost wages, benefits, and the chance to return to their job.
