In job applications, people don’t have to tell employers if they were arrested but not convicted. In fact, it’s against the law for employers to ask about arrests or look for information about on arrests. But employers can ask if someone’s out on bail waiting for trial.
There are some other narrow exceptions to the ban on employers asking about arrests. Employers may ask about arrests for certain jobs like government, law enforcement, or those involving drugs or health facilities.
